Running Deer Ranch consists of Running Deer Ranch #1 located from Aluffo Road to the boat ramp; Running Deer Ranch #2 is located from the Main Gate on Chimney Rock Road to Town Creek; and, Running Deer Ranch #3 (South Running Deer) is located across Chimney Rock Road. All three locations have access to the Lake and the boat ramp, and have access though the Main Gate on Chimney Rock Road.

In 1977, a Grant Deed of Easement was given by the owner of the parcel located to the right of the boat ramp to Running Deer Ranch Company, Inc. This non-profit corporation was formed only to protect this easement known as the "Point." In 1983, the Corporation was renamed San Luis Obispo County Running Deer Ranch Company, Inc. At this time the Corporation’s specific purpose was stated as "…to preserve the recreational easement of the Point property and maintain the roads so all members may get to, use and enjoy the Point."

The SLO Running Deer Ranch Inc., has a Board of Directors that is elected each year at the General Membership Meeting which is held on Memorial Day weekend. Dues are collected from members each April and Newsletters are sent out periodically. The dues are set at the Memorial Day General Meeting each year for each property owner. The By-Laws establish identical dues for each "family: in RDR. This means if a piece of property is owned by two separate families, then each family pays identical dues. A Point Key is issued upon receipt of a signed CUP and payment of your annual dues.

The SLO Running Deer Ranch, Inc., maintains Aluffo Road to the boat ramp. At the 2004 General Membership meeting the "Road Reserve & Allocation Proposal" was approved. This established an allocation process for road maintenance of Aluffo Road, Las Tablas Bay Drive, High Meadow Drive & Maple Canyon Drive.

The South Nacimiento Road Association (SNRA) maintains Running Deer Road from the Main Gate to the Gage Irving "Y" and Gage Irving Road to Town Creek. RDR property owners contribute a portion of their dues to SNRA every year for their fair share of this road maintenance. Over the last 15 years, the roads have been improved from dirt to paved roads thanks to the cooperation of all property owners and the SNRA.

The Main Gate is electric and property owners must have a code to open the gate. As a new property owner, please contact Leo Kennedy for your gate code. The RDR code is changed periodically; the contractor/guest code is changed monthly. The contractor/guest code is the code you should give to guests and/or contractors that are doing work for you. You can e-mail Leo at runningiron@wildblue.net or call him at 805-226-0697. Proof of ownership is required. You should have received a Main Gate key from the person you purchased your property from. It is IMPERATIVE that you have a key for emergency situations, i.e., when the power goes out and you must manually open the Main Gate. Please contact the RDR Treasurer for a Main Gate key.

BY- LAWS

 

ARTICLE I – OFFICERS

Section 1 – Principle Office – The principle office for the transaction of business for the Corporation is San Luis Obispo County Running Deer Ranch Company, Inc., 5050 Aluffo Road, Paso Robles, California 93446

Section 2 – Treasure’s Office – The dues, billing and other financial transactions will be presented to the aforementioned San Luis Obispo County Running Deer Ranch Company, Inc., 5050 Aluffo Road, Paso Robles, California 93446

ARTICLE II – MEMBERS

Section 1 – Definition of Members – Membership in the San Luis Obispo County Running Deer Ranch Co., Inc., (hereafter called Running Deer Ranch) shall be limited to property owners, their family members or heirs, of the parcels known as Running Deer Ranch #1, #2, #3. These areas include the parcels identified in the tax records as 80-112-XXX, 80-053-XXX, 80-054-XXX and 80-055-XXX. Members are further defined as those who have paid their yearly dues.

Section 2 – Number of Members – No limit is established on the number of members, so long as it can be determined that each is a property owner and has paid the yearly dues.

Section 3 – Transfer/Termination – Upon the sale of property, those members terminate membership in the Running Deer Ranch, negating all rights and privileges provided by same. Any member may terminate their rights and privileges in Running Deer Ranch by written request to the Secretary, or by failure to renew their yearly dues.

Section 4 – Assessments, Fees, Dues, Etc. – Since the Corporation has no legal right to assess its members, no assessments will be made. Fees for locks and keys for gated access to the private roads shall be required. Upon transfers of property, those keys, which have been provided, shall be returned to the Running Deer Ranch. Annual dues pursuant to the amount set at the Annual Membership Meeting, per member are due from each property owner who is desirous of obtaining membership in the Running Deer Ranch. This establishes identical dues for each "family" in RDR. These dues cover the calendar year and become payable on April 1st.

Section 5 – Annual Meeting – Annual Meeting shall be held once a year, on the Sunday of the three-day weekend of Memorial Day. The Annual Meeting will commence at 9:00 am. The meeting will be chaired by the officers of the Running Deer Ranch and will follow normal meeting practices. Members entering business into the meeting will be asked to identify themselves and will be required to be in good standing, or have permission to speak by the presiding officer.

Section 6 – Elections – Election of the Board of Directors of the Running Deer Ranch shall be held annually at the Memorial Day Meeting. The term of each Board Member shall be for a two (2) year period with four (4) new Board Members elected on even years and three (3) new Board Members elected on odd years. No Board Member may be elected for more than two (2) terms (4 years) without a one term hiatus, unless elected by a two-thirds majority of the members present. Election of the Board Members shall be accomplished by simple majority of members present.

Section 7 – Rights and Privileges – All members in good standing shall have voting privileges and be able to serve as board members or officers in the Corporation. Members in good standing shall be permitted the use of the Point property (easement granted to the Running Deer Ranch) for picnicking, etc., subject to the easement and Point rules and regulations. Ingress and egress to the launching ramp shall be available to all Running Deer Ranch property owners; however, temporary boat trailers storage is NOT available, except at the Point.

ARTICLE III – DIRECTORS

Section 1 – Management – All corporate powers shall be exercised by, or under the authority of, and the business and affairs of the Corporation shall be controlled by, the Board of Directors. Election of the Board of Directors shall be performed via general meeting by majority vote of the members in good standing. The Board of Directors shall be comprised of seven (7) members of the Corporation. The officers shall be elected for the ranks of the Board, and shall consist of the President, Vice President, Secretary and Treasurer.

Section 2 – Removal – A Director may be removed prior to term expiration by a vote of two-thirds of the members in good standing at a General Membership Meeting.

Section 3 – Meetings – Meeting of the Board of Directors may be called by any Director; however, notification of the Board Meetings shall be coordinated and provided by the Secretary to all Board Members. Board of Directors Meetings are open to all members in good standing, as well as invitee of the Board members. In general, Board Meetings will be held within the confines of Running Deer Ranch. Each Director, Officer, Committee Chairman is expected to provide a report for each Board Meeting. Attendance at the Board Meetings shall be made public at the General Meeting, such that the members are aware of the Director’s participation.

Section 4 – Committees – The Board of Directors may create any such committee, as it deems desirable to carry out the workings of the Board. At least one Director shall be appointed to any committee formed and the Director shall be responsible to the Board and Membership for that committee’s actions. Such committees as roads, gate, point, fire, etc., are anticipated.

Section 5 – Quorum – A quorum of four (4) Directors is required at any Board Meeting to transact business. Should a situation occur requiring timely action/response, telephone concurrence on a course of action by four (4) Board Members shall suffice, with notification provided to the remaining Board Members.

Section 6 - Filling a vacancy - The vacancy of a member of the Board of Directors within 10 months of the last Annual Meeting shall be filled by an affirmative majority vote of the remaining Board of Directors. Any vacancy after 10 months of the last Annual Meeting shall be filled by an election at the next Annual Meeting. Nominees for the Board of Directors may be submitted by any Member of Running Deer Ranch.

ARTICLE IV – DIRECTORS

Section 1 – President – The President of the Corporation shall be elected for a period of one (1) year by vote of the majority of the Board of Directors. The President shall not serve more than two (2) terms successively. A Board member may be elected to an office following a one-year hiatus from that office. The President shall preside at all Board Meetings and General Membership Meetings and shall provide a detailed report to the general membership annually. The President shall provide the Secretary, for maintenance, all legal documents relative to the Corporation.

Section 2 – Vice President – The Vice President shall be elected annually by the Board Members for a period of one (1) year. Similar restrictions are imposed on the Vice President as those of the President. The Vice President shall perform the duties of the President in the event of his or her absence or disability.

Section 3 – Secretary - The Secretary shall be elected by the Board Members for a term of two (2) years. Similar restrictions apply to the Secretary as those of the President. The Secretary shall be responsible for the minutes of the Board Meetings, General Membership Meetings, Corporate correspondence and publishing the newsletter.

Section 4 – Treasurer – The Treasurer shall be elected by the Board Members for a term of two (2) years. Similar restrictions apply to the Treasurer as those of the President. The Treasurer shall receive and disburse all funds and maintain a record of receipts and disbursements of such funds. The Treasurer shall provide a financial report at all Board Meetings and a detailed report at the Memorial Day Annual Meeting. The Treasurer shall be responsible for providing projected budget for the upcoming year at the same Memorial Day Meeting. An independent review of the financial report shall be required annually, for presentation at the General Membership Meeting.

Section 5 – Past President - At the completion of the President’s term, he/she shall serve one additional year on the Board of Directors, sitting as the "Past President" The "Past President" will serve in an advisory capacity only and will not have voting privileges. The Past President will not be counted as one of the seven elected Board Members.

If a President is elected and serves for one year only, and at the end of that year has one year remaining of their elected two-year term, or if the "past president" is elected to serve another two-year term, the "past president" would then have voting privileges as a member of the Board of Directors and be counted as one of the seven members that comprise the Board of Directors

Section 6 – Removal of Officers – Removal of Officers prior to term fulfillment shall

require a vote of four (4) Board Members.

ARTICLE V – MISCELLANEOUS

 Section 1 – Terms -

 

"Board"               Board of Directors of this Corporation.

 

"Corporation"     San Luis Obispo County Running Deer Ranch, CO., Inc.

 

"Members"          Participating members in good standing and their families.

 

"Designee"         Person designated by the owner of the parcel to represent him/her in   voting matters pertaining to Running Deer Ranch.  Designation must be in writing.

 

"Renter"              A person who pays rent for the temporary possession or use of  a house,   land or other property.

 

"Guest"                A person entertained at the home of another; visitor.

 

"Family"                A group of people related by ancestry or marriage; relative.

 

Section 2 – Liquidation – Upon liquidation of this Corporation, voluntarily or involuntarily, after payment of its obligations, the remaining assets shall be converted to cash and distributed into equal shares to all members in good standing at the time of liquidation.

Section 3 – By-Laws, Rules & Regulations and Conditional Use Permit AmendmentsThe members may vote to adopt, amend, repeal or revise the By-Laws, Rules & Regulations or Conditional Use Permit, provided the total votes received equal or exceed 50% of the RDR members in good standing. The By-Laws may be changed with a 2/3rds majority, the Rules & Regulations or Conditional Use Permit with a majority of 50% plus 1 of the votes received. The proposed changes will be sent out to all members in writing no less than one month before a special or regular Annual Meeting and the votes will be collected and counted at the meeting. Votes can be accepted by mail or e-mail prior to the meeting.

The Board of Directors may recommend changes in the By-Laws, Rules & Regulations or Conditional Use Permit to the general membership.

Any member in good standing, with a second from another member in good standing, may propose amendments to the Board of Directors at any regular Board Meeting. The submission of this request can be accomplished either in person or in writing. All amendments must be submitted to the Board of Directors at least 45 days before the general membership meeting in order to allow a 30-day notice to the general membership prior to voting. A Board meeting must occur between 75 days and 45 days before the general membership meeting.

All properly submitted proposed amendments, except those that would violate the Grant Deed of Easement, which is the Board’s responsibility to protect, will be presented to the membership. The Board may indicate to the membership whether or not they endorse, oppose or remain neutral on the proposed amendment.

 

Section 4 – Easements – Easements have been granted to Running Deer Ranch for member use of the Point. An easement is in existence around the launching ramp. Since the ramp is actually closer to the side away from the Point, no docking or boat parking is permitted on the left side (when viewed looking towards the Lake, i.e., the Town Creek side) of the ramp.

Section 5 – Projects – Long-range projects shall be approved by the general membership.

Section 6 - Robert’s Rules of Order - "Robert’s Rules of Order Newly Revised" shall govern all Running Deer Ranch Co. Inc. meetings in which they are applicable.

RULES & REGULATIONS

 

I. THE POINT

SLO Running Deer Ranch Company, Inc., as recorded Trustee for the "Point", requires that a Conditional Use Permit be signed by each Running Deer Ranch landowner who wishes to have access to the Point for the prescribed recreational uses named in the Grant Deed of Easement. Only Running Deer Ranch members in good standing and their accompanied guests shall be permitted the use of the Point property subject to the following rules and regulations.

Violation or noncompliance of any of the following rules or conditions can jeopardize each landowner and/or his or her guests use, as well as all other property owner's conditional use of the Point.

A. Camping or Overnight Parking:

There shall be no camping or overnight parking on the Point.

B. Trees and Shrubbery:

There shall be no removal of trees or shrubbery.

C. Litter, Garbage, Polluting Substances:

There shall be no dumping or depositing of trash, refuse, garbage, litter, motor oil, gasoline, human waste or any kind on any portion of the Point, except in approved containers to receive such waste materials.

D. Fire Restrictions:

There shall be NO ground fires, fireworks, or other fire hazards. Cooking fires shall be permitted in an approved container.

E. Portable Restrooms:

The use of portable restrooms shall be used for its intended purpose. There shall be no bottles, cans, diapers or other pieces of trash that may plug up the removal process of said containers.

F. Indecent Language or Gestures:

There shall be no use of threatening, abusive, insulting or indecent language or gestures.

G. Beach Area:

All members are to respect the rights of all members and/or their guests in the landing, launching and mooring of their docks and/or boats on the Point's community beach area. Boats and/or docks shall not be moored in such a way as to hinder other members from launching their boats or using the launch ramp.

H. Docks:

All docks shall meet all requirements of all building, licensing and regulatory agencies. All dock owner(s) shall provide adequate public liability and property damage insurance to hold the current owner (s) of the Point parcel harmless from any liability arising out of the operation or use of said docks. Dock owners shall provide a copy of their current Dock License and Insurance coverage to the RDR Board on a yearly basis.

I. Excessive Noise:

No sound amplifying equipment shall be operated at any time at such a volume as to interfere with the enjoyment of the Point by members and/or their guests, or with the peaceful enjoyment of members on private property outside the Point area.

J. Driving Safely on the Point:

All members and/or their guests shall abide by the speed limit signs posted at the Point. All California Vehicle Codes are to be observed and adhered to.

K. Launch Ramp:

All members and/or their guests shall use the designated launch ramp for boat launch only. Members and/or their guest shall not launch in any other area on the Point.

L. Holiday Weekends:

During all holiday weekends, parking of any watercraft and or watercraft trailer is prohibited on the Point due to the large number of members and/or their guests.

Members are encouraged to use reasonable judgment as to the number of guests invited so as not to infringe on the rights of the dues paying members’ use of the Point

M. Guests, Renters, Non-Members:

Guests, renters and other non-members are not allowed on the Point if they are not in the company of a member in good standing. Guests, renters and other non-members who are on the Point and not accompanied by a member in good standing are trespassing and are subject to the laws of trespassing, which may result in arrest and impound of vehicles and/or trailers.

                                N. Landowners and Guests or Renters:

Landowners and/or their guests or renters that jeopardize the Trust by not following the Point Rules will have their rights and privileges revoked for the remainder of the year. Dues paid by the owner will be forfeited. If the landowner and/or guests or renters continue using the Point, they are subject to the laws of trespassing, which may result in arrest and impound of vehicle and/or trailers. A special Board of Directors meeting will be held as soon as possible to discuss the penalty.

II. TRASH:

Individual property owners are responsible for their own trash and its removal. Said trash shall not be dumped on the point or other open areas or in designated containers for use at the Point.

This form has been created to protect your conditional use of the Point by way of the Grant Deed of Easement. SLO Running Deer Ranch Company, Inc., as the recorded Trustee for the "Point", requires this CUP to be signed by each Running Deer Ranch Landowner who wishes to have access to the Point for the prescribed recreational uses named in the Grant Deed of Easement. I/We agree to obey all the rules set forth in this document and hereby acknowledge responsibility for my/our guest(s) and my/their actions. My/our right and privileges to use the Point can/or will be revoked if my/our and/or my/our guest fail(s) to follow any of the agreed upon Conditional Use Permit Rules for using the Point.

Subject:  CONDITIONS TO MOOR YOUR DOCK AT THE POINT 

All docks and permanent boats used as docks must meet certain use conditions.  These conditions are set by Ordinance No. 3672 - Monterey County Dock Licensing; and the Grant Deed of Easement that permits RDR property owners use of the Point.

 Ø      Section 6. of Ordinance No. 3672 INDEMNITY AND INSURANCE reads:

 Before any initial license and any renewal license is issued by the General manager, a licensee must file with the General Manage (a) a certificate of insurance issued by a company authorized to do insurance business in the state of California, providing that the insurer will give to the Agency thirty days notice of cancellation and (b) an agreement executed by the applicant holding the Agency and Monterey County and their officers, agents, and employees harmless for any damage or injury resulting from the installation or use of the dock.  The insurance shall have a combined single limit of not less than $100,000 for public liability and property damage.  The Supervisors may amend the required amount of insurance by resolution, and such amendment shall be effective for all initial and renewal license issued after the effective date of the resolution. 

Ø      The RDR Grand Deed of Easement was made and accepted subject to certain conditions.  Conditions 4 and 5 required that any and all boat docks constructed upon or appurtenant to the land set forth in Exhibit “A” , shall meet all requirements of all building, licensing and regulatory agencies;  and, any person, persons or entity constructing, operating or owning any such boat docks as described in number 4 above, shall hold Point land owners, now Jess Felgenhauer,  harmless from any liability arising out of the operation or use of said docks. In addition, the RDR Board of Directors require that San Luis Obispo County Running Deer Ranch Company inc. shall also be held harmless.

 Based on the above requirements, the following documentation is required from each owner who has a dock moored at the Point; or a boat being used as a dock permanently moored at the Point.
